1. Introduction
Welcome to Harmony & Healing’s website. We provide live, professional “musical visits” for hospice and hospital patients. By using our site and services, you agree to these Terms of Service. Please read them carefully.
2. About Us
Harmony & Healing is a nonprofit organization dedicated to bringing comfort and joy to hospice and hospital patients through music. Our website allows individuals to request musical visits for their friends or loved ones.
3. User Conduct
Users of our website and services agree to:
- Provide accurate information when requesting a musical visit
- Respect the privacy and dignity of patients receiving musical visits
- Not use our services for any unlawful or disruptive purposes
4. Musical Visit Requests
- Requests for musical visits are subject to availability and approval
- We reserve the right to decline any request at our discretion
- By submitting a request, you confirm you have the patient’s consent (or their legal guardian’s consent) to receive a musical visit
5. Patient Privacy and Consent
- As a non-medical organization, Harmony & Healing is not legally bound by HIPAA regulations. Despite this, we are committed to protecting patient privacy and maintaining the confidentiality of all information shared with us
- We prioritize patient privacy and adhere to ethical standards of confidentiality
- Users requesting visits must ensure they have the right to do so on behalf of the patient
- Our musicians will respect all hospital or hospice rules and patient wishes during visits
- The patient has the right to agree or disagree to the use of Harmony & Healing Zoom recordings or photos taken during each musical visit for marketing purposes of the organization
- It is the sole responsibility of the person making the request to agree or disagree to the use of such recordings or photos on behalf of the patient
- If consent is given, it can be revoked at any time by contacting Harmony & Healing
- We will not use any recordings or photos without explicit consent
6. Intellectual Property
All content on this site is the property of Harmony & Healing unless otherwise noted. This includes any recordings or materials related to our musical visits.
7. Donations and Financial Information
- All donations support our mission of providing musical visits
- We provide transparent reporting on how funds are used
- Donations are tax-deductible as allowed by law (consult your tax advisor)
8. Liability and Waiver
- Harmony & Healing shall not be liable for any damages or complications arising from musical visits
- By requesting a visit, you waive the right to hold Harmony & Healing responsible for any unforeseen consequences of the musical visit
9. Professional Musicians
- Our musical visits are performed by compensated professional musicians
- Musicians are representatives of Harmony & Healing during visits and must adhere to our code of conduct
- We provide technical support to our musicians to ensure high-quality Zoom performances
- While compensated, our musicians have agreed to provide their services in support of our mission
10. Compensation and Donations
- Harmony & Healing compensates all musicians for their services
- Donations to our organization support our ability to provide these services and compensate our musicians
- We maintain transparency in our financial operations, including musician compensation
11. Service Quality and Limitations
- We strive to provide high-quality musical performances via Zoom
- Harmony & Healing does not conduct background checks on our musicians
- We do not provide medical or therapeutic services; our musical visits are for entertainment and comfort purposes only
12. Technical Requirements and Limitations
- Recipients of musical visits are responsible for ensuring they have adequate equipment and internet connectivity to receive Zoom performances
- Harmony & Healing does not provide equipment, software, or technical services beyond facilitating the Zoom session
- We recommend recipients test their Zoom setup prior to the scheduled musical visit
- Harmony & Healing is not responsible for any technical issues on the recipient’s end that may affect the quality of the musical visit
- In case of technical difficulties, we will make reasonable efforts to reschedule the visit
13. Disclaimer of Responsibility
- Harmony & Healing does not independently verify the credentials or background of our musicians
- Users acknowledge that they are responsible for any decision to accept our services
- Our musical visits are not a substitute for professional medical or therapeutic treatment
14. Changes to Services
We reserve the right to modify or discontinue our services at any time. We will make reasonable efforts to notify users of any significant changes.
15. Governing Law
These terms are governed by the laws of Contra Costa County, California.
